This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortious behavior, negligence, or under any other cause of action. You specifically acknowledge that MPM Screen Enclosures is not liable for the defamatory, offensive or illegal conduct of other subscribers or third parties and that the risk of injury from the foregoing rests entirely with you. In no event will MPM Screen Enclosures, or, any person or entity involved in creating, producing, or distributing MPM Screen Enclosures software, be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use the MPM Screen Enclosures software or site. You hereby acknowledge that the provisions of this section shall apply to all content on the site.

LIMITATION OF LIABILITY:

Under no circumstances, including but not limited to, negligence, shall MPM Screen Enclosures, it subsidiary and parent companies or affiliates be liable for any direct, indirect, incidental, special or consequential damages that result from the use of, or the inability to use MPM Screen Enclosures materials. You specifically acknowledge and agree that MPM Screen Enclosures is not liable for any defamatory, anti-competitive, offensive or illegal conduct of any user. If you are dissatisfied with any material contained within our site or with any terms and conditions listed here, your sole and exclusive remedy is to discontinue using the site.

INDEMNIFICATION:

You agree to defend, indemnify and hold harmless MPM Screen Enclosures, its parents, affiliates, licensees and their respective directors, officers, employees and agents from and against all liabilities, claims, damages, and expenses, including attorneys' fees, arising out of your use of the site.

CONTRACTORS:

As a MPM Screen Enclosures "Contractor" you agree to the following:

• Arrive at the required time to start patio project (unless otherwise approved by MPM Screen Enclosures Management).
• Wear the proper work clothing to ensure your safety on the job against the weather and machinery.
• No drinking or drug use or any actions that may misrepresent MPM Screen Enclosures.
• Follow directions from the crew leader or MPM Screen Enclosures Management onsite.
• If any company equipment or customer property is damaged by the  contractor, MPM Screen Enclosures Management reserves the right to deduct the damage amount from the contractor final pay.
• Final payment for the patio project will be paid after the job has been fully completed.
• If a "Patio Project" is not completed in the estimated/planned time, the contractor is responsible to continue working on the patio project until complete. (Unless otherwise directed by MPM Screen Enclosures Management).
